Thus dog barking in a multi-family house belongs to the average noise spectrum, and it is said (AG Hamburg, Urt. v. 06.03.2005, 49 C 165/05).

Occasional barking is always reasonable. This applies if the tenant gets in attendance or comes home, and the dog welcomes it. He may also react to sudden noises by barking (AG Hamburg-Wandsbek WuM 1991, 94). The tenant behaves contrary to the contract only if the dog constantly barks over hours or at night. No special regulations apply to guard dogs either (OLG Düsseldorf WM 1990, 400).

If a neighbor is bothered by the barking of a dog, he can demand that the landlord ask the dog owner to give up the animal or reduce the rent. If the disturbance of the neighbors reaches an unacceptable level, the landlord must revoke the permission to keep the animal from the tenant concerned (LG Hamburg WuM 1999, 453). If the dog belongs to a neighbor who is not a tenant, the landlord must take legal action against the dog’s barking if necessary. If he does not do so, he inevitably exposes himself to claims for reduction by his tenant.
